TERMS AND CONDITIONS OF BOOKING – created August 2026

Please read these conditions carefully as they act as your Agreement of Booking.

CONTRACT

When you make a booking with us you enter into a contract for which the following terms & conditions apply.

BOOKINGS

The booking will be accepted and the contract will apply when we issue an email to you confirming your booking. You may make a booking by contacting us directly by sending an email to info@jacksplacewhitby.co.uk, or by completing our on-line booking process on the website at www.jacksplacewhitby.co.uk. Bookings must be made by persons over 18 years old.

PAYMENTS

Once a booking is made/confirmed a 20% deposit will be taken

Upon payment of the deposit, you will remain liable for the full balance when due if this has not already been paid.

Bookings made within 60 days of your check-in date must be paid for in full

For a booking made more than 60 days before your check-in date, a deposit of 20% of the total rate is payable with the remaining balance being due a minimum of 60 days prior to your check-in date.

We will attempt to charge your card for the remaining balance exactly 60 days prior to your scheduled check-in date. If payment of the balance is not able to be processed by us on or by 60 days before the check-in date we reserve the right to cancel the reservation & retain the deposit.

CANCELLATION

If you should need to cancel the booking for any reason you must notify us in writing via the email address stated in these Booking conditions.

If you should cancel more than 60 days before your arrival, you will be refunded your deposit in full.

Should you cancel between 60 days and 30 days before your check-in date, you will be liable for your 20% deposit any other monies paid will be refunded in full.

Cancellations inside 30 days will be liable for 100% of the booking value and we reserve the right to keep the full balance.

Should you wish to arrive after your check-in date or leave before your check-out date no refund shall be given for the period where you do not occupy the property.

HOLIDAY CHECK IN AND OUT TIMES

The holiday commences, unless otherwise notified, at 3:00pm on the day of check-in and terminates at 10:00am on the day of check-out.

Any guests found to enter the property prior to the allocated check in time or those who choose to leave the property after the stated check out time could incur additional charges.

USE OF PROPERTY

You agree that the number of people staying in our property will not exceed the maximum number stated on the website.

You agree that our cottage will be used for personal and domestic purposes only. You shall not use the property for any commercial purpose. 

You agree that our property will not be used for any activity or in such a way as to cause a nuisance or annoyance to neighbours of the property.

you agree not to use candles, lighters, matches, fires or BBQ’s in the property.

CARE OF PROPERTY

You and all members of your party agree to keep our property and the contents in the same condition and repair as found on your arrival.

You acknowledge that you are liable to pay for all damage to, at, or in the property during your booking which was directly or indirectly caused by your action or inaction.

Please note we know accidents happen and prefer to know about them so we can come and help clean up or replace the item for you or the next guests. You will not be charged for example for the odd broken piece of crockery etc.

Any appliance, fixtures and fittings must be operated in accordance with provided instructions and in a reasonable and careful manner.

You will take steps to ensure the security of the Property.

You will take care to avoid blocking or causing damage to drains or sanitary appliances and only flush toilet paper in the toilets.

You must ensure our property is left in a reasonable, clean and tidy state on your departure. We may charge you for the cost of any additional cleaning should this be deemed necessary especially but not limited to been caused by smoking, fake tan, hair dyes & henna.

LITERATURE, DESCRIPTIONS AND FACILITIES

We have compiled all the information you may see about our property as accurately as possible. However, occasionally some facilities, pieces of furniture, bedding, electrical items etc. may be altered or withdrawn for reasons outside our control, in which case we cannot accept responsibility. We will endeavour to provide a suitable alternative if this is the case.

Our property has Wi-Fi, however please note that its provision is subject to availability and network conditions and no compensation will be given if this provision is not available.

There is no charging point for Electric vehicles and no Electric vehicles must be charged on our property. If anyone is found to have done this they will be in breach of contract and the booking will be terminated and they will be asked to leave with no monies refunded.

PROPERTY KEYS

We will issue you with a key code to the property. All keys must be returned to the key safe on the departure date. If you lose a key/set of keys or lock yourself out of one of our cottages due the misplacing of keys, you may be charged for the replacement keys and any call out charge.

SMOKING

You or your party are not permitted to smoke in any part of the property. If it is evident that smoking has occurred during your stay, you may be required to pay for any associated cleaning costs.

PETS

No pets of any kind are allowed in our property. Any one found to have brought a pet of any kind will be in breach of contract and will have the booking terminated and be asked to leave with no monies refunded.

PERSONAL BELONGINGS/LOST PROPERTY

We do not accept any liability in relation to any damage to, or loss of your personal property and belongings except where such damage or loss is caused by the negligence of us. It is your responsibility to ensure that you have adequate holiday insurance cover.

HEALTH & SAFETY

For your safety it is important that you read and adhere to the important information provided within our property. This information includes; Fire Safety Notices and evacuation procedures as well as other information regarding appliances. We have ensured that the property is reasonably safe for the purpose of our customers’ needs however each customer has a duty of care to take care of his or her own safety. Please ensure that you use the facilities safely & responsibly.

COMPLAINTS PROCEDURE

We endeavour to do everything we can to ensure our guests have a fantastic stay, but we know that from time to time things do go wrong.

Here’s what to do if you need to make a complaint:
If there is something wrong with your accommodation or your stay please contact us on 07970775836 or info@jacksplacewhitby.co.uk  right away so we are given the opportunity to put matters right or investigate your concerns.

OUR COMMITMENT TO YOU

We will ensure that:

  • the property is cleaned and ready for your stay
  • you have instructions on how to access the cottage
  • we will treat all guests with respect
  • we can be easily contacted (at reasonable times) or will provide you with an alternative first point of contact should you have any concerns or emergencies during your stay
  • our property complies with all applicable laws and regulations
  • we have adequate liability insurance in place
  • you have exclusive access to the cottage for the duration of the holiday (unless access to the property is required for emergency repairs)

However, we cannot be responsible, nor liable for any events outside the our reasonable control, such as the breakdown of domestic appliances, plumbing, wiring, temporary invasion of pests, building works at adjacent properties, damage resulting from exceptional weather conditions or other unforeseeable circumstances. We also cannot be responsible for extreme weather, wildlife especially seagulls, and parking issues.
